The Design Should Be Used in News :

An article's design, not the content itself, is the item used in the article. The project should be used on an item that will be provided to the consumer as a finished article.

Eye Catching :

The design should be able to be applied to the item in a way that makes it appealing and only possible to be evaluated by the eyes. There should be an obvious draw to a certain shape, suspension, pattern, or design. The registration requirement must be "judged by eye" and "eye-catching." It might be argued that,

  • The features must be observable from the outside in order to catch the eye.
  • The customer should be drawn to the feature.

Additionally, it won't be registered under the Act if it has pornographic material. It was suggested that determining the sort of psychological activity engaged in the conceptualization of the project in issue was crucial to the experiments with innovation and originality. The designer can be said to have kept the original design and made some adjustments if the new design is simply a commercial variation of the old one. A unique psychological process must be engaged in order to come up with a fresh design. The freshness or ownership of a particular section of the article is insufficient to convey the piece's overall sense of youth and emergence. If the new combination has a discernible effect, it is possible to register a combination of previously published designs.

No Previous Publishing :

The design can only be registered if it hasn't already been published in India. A court ruled that publication means the polar opposite of confidentiality. Even a single exposure can result in a publishing. The Design Act prohibits the registration of designs that are not clearly distinguished from existing designs or combinations of existing designs. Publishing designs must be made available to the general public and then abandoned. E.g.: - A design is published when it is displayed on a saree during a fashion show.

Steps for registration of a design

  • Four copies of the project suspension and the application indicating the phase in which the project will be registered must be submitted with the application under Section 5. In India, we adhere to Locarno's system of 32 classes, numbered 1 through 31, plus an additional Class 99 to include any goods that do not come under the 31 classes already mentioned. The steps are as follows.
  • The patent office will receive an application for registration from the design owner. The application will be submitted in the required format and will be charged the suggested fee of Rs. 1000. According to section 5 (1), an administrator may register a construction under the Act upon request from any individual claiming to be the proprietor of a brand-new or original project that hasn't been previously published in any country and who doesn't oppose to public order and behaviour. The necessary fee and the prescribed form must be submitted with the application. The project's registration category will be specified in the application.
  • An inspector designated under this Act will receive an application from the Controller prior to registration to ascertain whether the project qualifies for registration under this Act. If the controller is convinced that the design conforms with all the requirements for registration under this Act, the controller will register it once the regulator has taken into account the inspector's findings. Construction registration could be rejected by the controller if they decide it's necessary. Anyone who is offended by such a rejection may file a High Court application. A design whose usage would be against public morals or order could be rejected by the regulator.
  • A statement of the objection will be communicated to the applicant or his or her representative if the Controller objects to processing the application. Once the applicant has failed to resolve the objection within a month of being notified of it, the application will be presumed to have been withdrawn. He or she may also request a hearing on the case from the Regulator. The applicant may submit an application directly to the Central Government if the Regulator rejects it after submission.
  • The Central Government's determination regarding the project's registration is final
  • The Controller will order the design's details to be published as soon as it has been registered, and after that it will be available for public inspection. The patent office maintains a design register that includes data such as the names and addresses of registered design owners, share notices, and other specifics. After the aforementioned steps are finished, the controller will give the applicant a registration certificate.
